Take Action: Will NY Gov. Hochul fire the healthcare heroes of 2020?

As one of her first acts Governor Kathy Hochul had health commissioner Howard Zucker, a leftover from the Cuomo administration, issue illegal regulations that require New York's healthcare heroes of 2020 to get the still experimental Covid-19 shots or lose their jobs. Hochul is also illegally denying workers the right to even apply for a religious exemption to the shots.
Highly-experienced, credentialed, licensed, healthcare professionals who went through 2020 are refusing the Covid shots. You would think that fact would give pause to anyone who is even semi-conscious. Officially the state is saying 25% have yet to get the shots, but we are hearing from insiders at the largest hospital corporations in New York that the real number is between 40% and 50%.
The State cannot order anyone to get shots, nor can it order anyone to get a product that is available only under an emergency use authorization, nor can it deny workers religious exemptions. But Governor Hochul, and lame-duck New York City Mayor de Blasio, are trying to leverage their positions to force as many people as possible to get the shots using any method they can whether legal or not. The end game is obviously to force everybody, children and adults, to get the shots. We can fully expect to spend 2022 fighting efforts to force Covid shots upon all of us.

Please call your State Senator and Assemblymember and ask them what they are going to do about this stunning lawlessness by the Governor? Gov. Cuomo was notorious for his contempt for the legislature, and Hochul appears to have started down the same path. The legislators are acting like whipped dogs, when are they going to start doing the job they were elected to do?
The Governor cannot legally order anyone to get shots
Hochul's order is illegal because neither the Governor nor the Health Commissioner has the legal authority to command anyone to get a vaccine. This principle was clearly spelled out by the New York Court of Appeals (New York's highest court) in Garcia v. New York City Department of Health and Mental Hygiene, a 2018 decision that unequivocally determined that the only way the State can order anyone to get a vaccine is by passing a law. No law has been passed.
The available shots are not FDA approved
It also illegal because the only shots available are the Pfizer, Johnson & Johnson, and Moderna vaccines that are still under an Emergency Use Authorization (EUA). Contrary to all the propaganda those products were not approved by the FDA, and federal law prohibits any level of government from requiring a product released under an EUA, which also includes PCR tests. The much ballyhooed "FDA approval" of the Covid shots announced last week by the Biden administration is not for the Covid shots currently in use and available. It is only for a different product called "Comirnaty" that is not available. Biden and crew did a bait switch scam. And does anyone believe that a full and complete analysis consistent with federal law of the "Comirnaty" product was done?
Hochul may not disregard State and federal law giving workers a right to a religious exemption
Workers have a right to a "religious accommodation" for religious beliefs and practices under both federal law, in Title VII of the Civil Rights Act of 1964, and under the New York State Equal Rights Law. Hochul may not simply disregard federal and state law.
